SC says no to independent probe into death of Judge BH Loya

The apex court dismissed a batch of petitions seeking an independent probe into the death of special CBI judge BH Loya, the family had said. All of these lead to several petitions being submitted to the Court seeking clarification on the situation as well as requesting an independent probe by the SIT on Justice Loya's death.

Jaitley also targeted lawyers who had filed public interest appeals in the judge Loya case and called them "Institution Disruptors".

It had come down heavily on alleged accusations, bullying of judges in the top court by some activist lawyers in the Loya case and said that the judiciary and judicial officers need to be saved from such averments. Attempts by some people with vested interest to defame Amit Shah by way of filing a PIL have been given befitting reply by the SC through its judgement passed today. The bench particularly took serious note of Bhushan's plea that two of the judges - Khanwilkar and Chandrachud - should recuse themselves from hearing the matter as they come from Maharashtra and must be knowing all judges of the Bombay High Court concerned with the case. There is no reason for the court to doubt the clear and consistent statements of the four judicial officers.

Loya had died of cardiac arrest in Nagpur on December 1, 2004 when he had gone to attend the wedding of a colleague's daughter.

Jaitley also slammed Caravan, which had published articles raising questions over the death of Judge Loya.

Beene can hang around in this match if he can continue to get his first serves in play, but that doesn't mean I'm predicting an upset.

"The documentary material on the record indicates that the death of judge Loya was due to natural causes".

Judge Loya was dealing with the Sohrabuddin Sheikh encounter case in which BJP chief Amit Shah was then an accused.

Hitting out at Surjewala, Javadekar said Gandhi made capital of it by addressing a press conference and taking 150 MPs to the doorsteps of the President of India.

BJP State president K Laxman and former Union Minister Bandaru Dattatreya, who were also present, said Congress was unable to digest the continuous victory of BJP.

"Congress and its president Rahul Gandhi, the Communist parties, their allies" and "some media houses" must apologise" to our country for spreading such utter lies against our (BJP's) national president Amit Shah", he tweeted. "But there are still questions before those who believe in the judiciary", he said, raising 10 questions relating to the case as he criticised the verdict. "It is a sad letter day in India's history", he said.
