Juvenile convict in 2012 Nirbhaya gang-rape case untraceable: WCD Ministry

The convicts in the December 16 gangrape and murder case will hang, the Supreme Court said on Monday, reaffirming the death sentence of three of the four death row convicts and holding that "no grounds" have been made out to review the top court's decision past year to give them capital punishment.

A three-member bench led by Chief Justice Dipak Misra dismissed petitions filed by the men to review a 2017 order by the top court, which had confirmed the death penalty given to them by the Delhi High Court. A fourth man, Akshay Thakur, did not petition the court to review his death sentence.

Former Congress MP and renowned industrialist, Naveen Jindal, said, "Welcome the SC decision dismissing the review petition and upholding death sentence of the rapists".

The 23-year-old physiotherapy student was attacked on a bus as she and a male friend returned from watching a film in December 2012.

One of the accused, who was a juvenile at the time of the incident, has been sent to a reform centre for three years while another, Ram Singh, was found dead in jail. "However, I am happy that my daughter has finally got justice", Singh told reporters.

All pleas of convicts were taken into account during hearing of appeals against HC order and no new ground has been raised in review petitions to warrant reconsideration of death penalties awarded to them in May2017, the Bench observed.

A fast track court had covicted four to death in less than year after the brutal gang-rape and murder of the paramedic student. Failing to get any relaxation in death sentence from it, a mercy plea before the President would be the last resort for them. It also put focus on the increasing number of crimes involving juveniles, bringing about change that would see them tried as adults under specific circumstances.

According to National Crime Records Bureau data for 2016, incidents of rape of children in India increased by over 82 percent compared with 2015, when almost 35,000 rape cases were reported to the police.

The gang rape of an eight-year-old girl from a Muslim nomadic community in January has sparked more protests. The Delhi High Court upheld that verdict in 2014. Dec 29, 2012 the girl succumbed to injuries.

Sentencing the four in 2013, Judge Yogesh Khanna said the case fell into the "rarest of rare category" which justifies capital punishment in India. On July 9, 2018 SC will decide the fate of the four accused of death sentence in the Nirbhaya gang-rape case.

Out of the 371 death row convicts in 2017, 43 were awarded the ultimate punishment for crimes involving fatal sexual assaults.
