Independent lawmakers and the opposition Labor party voted together to pass the bill by 75 votes to 74, dealing a blow to the ruling conservative coalition, which is trailing heavily in polls ahead of an election due in May.

Labor workplace relations spokesman Brendan O'Connor said the Prime Minister had chosen to "misrepresent the truth" and "lie to the Australian people" in an attempt to gain political advantage when he should be safeguarding the national interest.

"We want strong borders", he said.

However, the immigration minister would still have some authority to overrule transfers.

"The current Australian government policy indicates that only life-threatening cases, where a third-country option is not available or appropriate, can be considered for transfer to Australia", minutes of the committee meeting released under Freedom of Information reveal.
